Complex Commercial Litigation
Contract, business-tort, and other complex disputes
Showalter PLLC represents companies and individuals in contract, business-tort, and other complex commercial disputes in state and federal trial courts and in arbitration. The same senior lawyers who write the firm’s appellate briefs write its trial-court motions, so the record is built with the appeal in mind.
Showalter PLLC’s commercial matters
The firm’s first-year commercial matters include the following:
- Defend a closely held company in a contract dispute in state court.
- Represent an individual in federal district court, with claims and counterclaims sounding in contract and tort.
- Defend a company sued on a multimillion-dollar promissory note in state court, and assert counterclaims.
- Represent a company in a JAMS arbitration to collect unpaid fees under a marketing contract.
- Defend a company in a commercial dispute in state court.
- Represent a company in a contract and unfair-trade-practices dispute with an overseas supplier.
- Represented a lender suing on a defaulted loan and guaranty, with fraud claims against borrowers who were dissipating assets, in state court and a related bankruptcy proceeding, and obtained a default judgment.
Michael Showalter’s commercial experience
At Gibson Dunn, Michael was a leader on a team representing a foreign mining company in a multijurisdictional effort to enforce an international arbitration award of approximately $500 million, including fraudulent-transfer claims against judgment debtors in Florida and New York state courts. He has been the lead drafter in matters before the Delaware Court of Chancery and state and federal trial courts involving complex commercial litigation, contract interpretation, class certification, and tort law, and he has drafted dozens of trial-court motions and dispositive briefs. Two years out of law school, he defeated Microsoft pro se before the U.S. Trademark Trial and Appeal Board.
Charles Tyler’s trial-court experience
At prior firms, Charles Tyler represented a medical-device manufacturer in post-trial motions that reduced a punitive damages award from $22 million to $3 million, and a global oil company in a civil RICO case against lawyers and judges who had obtained a judgment against it in a foreign court through corruption.
Ready for emergencies
We can handle a temporary restraining order on a few days’ notice. When another firm backed out of a Supreme Court amicus brief, we started on a Saturday morning and delivered a draft on Monday morning.
